D.U.I. - Driving Under the Influence

Have YOU been arrested for DUI???   Then you need an attorney. Every DUI can have a defense.

Why were you arrested for DUI?  Nobody is a perfect driver…and the police use that fact to as an excuse to pull you over.  Many police officers' are poorly trained.  They might use suspect methods for pulling you over.  These need to be properly investigated and brought to light.  

 

Did you "blow"?  Well, did you know that the Breath machines must be properly and rigorously maintained accordingly to the exact standards and guidelines of the Florida Department of Law Enforcement.  It is the State's burden to prove that the machine worked properly.  Those machines must be challenged by your attorney.  

 

Many times, the police do not take the time to follow the procedures when investigating DUI suspects.  The attorney must investigate the officers' background and training, as well as the entire case.  

 

Your arrest form probably stated you had "blood shot and watery eyes, an odor of alcohol, flushed face, and slurred speech."  The vast majority of DUI arrest read the same way, as if they came pre-printed.   You need a lawyer who will investigate those claims. For example, illness, injury, or fatigue could explain any number of those "indicia of alcohol."

 

Often times, the police will make a person accused of DUI perform roadside exercises, which many people fail for reasons completely unrelated to drinking.  Were you sick? Dizzy? Nervous because some cop pulled you over? Were you blinded by flashing police lights?  Was the pavement uneven?  Was it raining?  Was there busy traffic nearby?  And, ladies, were you wearing high heels?  Your attorney needs to bring these facts to light!
